Judge Denies Apple’s Demand To Block Samsung Galaxy Tab 10.1 Sales In The US

Apple and Samsung have filed suits against each other all over the world including the United States. Although many decisions have been in favor of the Cupertino-based company, most of them have been overturned. Anyway, in the US, Apple wanted to ban the sales of several Samsung devices, however, a Judge in San Jose has ruled out in favor of the South Korean manufacturer.
Judge Lucy Koh said that this doesn’t represent the end of the lawsuit as Apple is close to proving that Samsung is infringing one patent of the iPhone maker. This patent, however, is not related to the smartphone division of Samsung, it’s about the tablet business where the Samsung Galaxy Tab 10.1 makes use of an Apple patent. The Cupertino lawyers will have enough time to show that the patent is valid and that it infringes on the technology used by the iPad.
Apple wanted the Judge to rule in favor of the sales ban of the following devices: Samsung Galaxy S, Samsung Infuse 4G, Samsung Droid Charge, and Samsung Galaxy Tab 10.1. The lawsuit in the United States is not related to the lawsuits in nine other countries, though the subject is similar.
Back in April, Apple filed suit against Samsung for copying the design of the iPhone and iPad in the aforementioned devices. Cupertino believes that consumers can mistake Samsung’s devices with its own smartphones and tablets, but in the US there has been little success.
Previously, it has been proven that Apple “photoshopped” some of the pictures used in several lawsuits in order to give the Judges a false impression over the allegations. Even now, nobody took any actions against Apple for this matter. We don’t deny that Cupertino might be “right” in this problem, but at least it can do, is to provide accurate proof.
Recently, Samsung has been re-allowed to sell the Samsung Galaxy Tab 10.1 in Australia after being denied several weeks ago. However, Apple can still appeal this decision where the High Court will have the last say.
These wars do no good to the consumers as companies focus in battling against each other instead of innovating. Let’s just hope that we’re going to see new products at the Consumer Electronics Show 2012 which takes place next month at the Las Vegas Convention Center.
