ITC Judge Bans HTC Smartphones Sales In The US Due To Infringement On Apple Patents

A couple of weeks ago the ITC has found out that HTC is infringing a couple of Apple patents in its Android smartphones, however, the Judges have delayed a final decision until now: the Taiwan-based company has been banned from selling certain handsets in the US as of April 19th, 2012. This will give the Taiwanese firm enough time to settle its problems, while Apple will have a beautiful Christmas as it won the war against HTC in the United States.

HTC has responded immediately and praised the Judge who said that the “721 and 983 patents” infringe Apple’s patents, while the 263 patent isn’t in question. The fourth patent which was being discussed was the 647 patent, but HTC will release a software update soon enough in order to remove this UI experience from the devices in question. It’s unclear what the UI experience really does and how it will affect the users, though we must say that the good thing is that HTC will solve the problem soon.

Apple fanboys should brag about winning a small war and say that Android is copying iOS in one way or another as the patents only refer to data tapping. All smartphone makers in the world use this feature, but ITC has ruled out that HTC is copying Apple’s implementation of this tool. The feature allows users to click on phone numbers sent via SMS text messages or via emails so as you can see, it’s not a big deal and we’re sure that the Taiwan-based company will fix the issues before April 19th next year and it will keep selling its devices in the United states.

The ITC Judge confirmed that HTC will be allowed to keep selling its devices in the US if it will find another way to implement this feature which is available in all other operating systems in a different way.

Just like we were expecting, this WILL NOT affect in any way Apple or HTC, but it will have a negative impact on consumers who will believe that Android is copying iOS. This saga needs to end, the consumers need to learn the truth, and the companies must end this stupid wars and focus on innovating. If this is everything that Apple has in its backpack, then it’s losing the respect of many people. Like said, we’re hopeful that these silly things will go away in 2012. Happy Holidays to you all!
