Megaupload User Data Will Not Be Deleted For At Least Two Weeks

Yesterday we reported that the data on Megaupload’s servers might be deleted as soon as Thursday because the company has seen its assets frozen by the FBI and the Department of Justice. This means that the company cannot pay the two firms which are responsible for hosting Megaupload.com. The Feds as well as Megaupload’s owners said that Carpathia and Cogent will begin deleting the data as of Thursday because the payment will be overdue. Today, the lawyers announced that they’ve reached an agreement with the hosting companies and the data will not be deleted for now.
Kim Dotcom and six other people have been arrested and accused of copyright infringement and money laundering as it’sВ believed that they’ve gathered up to $175 million from Megaupload, a website which was housing pirated content. As it’s illegal to host copyrighted material, the Feds filed a complaint against the website’s owner and employees, and if they’re going to be found guilty, they’re facing up to 20 years of prison.
Megaupload’s lawyers feared that the users will not have a chance to get their data back because the Feds frozen the company’s accounts thus making it unable to pay its hosting partners. Ira Rothken, one of Kim Dotcom’s lawyers, said that an agreement has been reached with both Carpathia and Cogent in order to delay the payment date with two more weeks.
Carpathia Hosting also confirmed the news, and made another announcement as well. The storage firm said that users shouldn’t contact Carpathia over this matter because it doesn’t have access to the Megaupload data. The company said that it cannot return the data of Megaupload users because it doesn’t have access to it. Only the website’s employees had and have access to the Megaupload’s servers.
If Carpathia would try to access Megaupload’s servers, then the company would break the law. It’s up to the Feds whether Megaupload will get its money back in order to pay the two hosting firms, and access the servers to give the files back to the users.
Lawyer Rothken said that he’s looking to find a way to convince the Government to give the data back because there are millions of users who uploaded personal files, work documents, and other important data.
On the other hand, the Feds say that they’ve backed up some of Megaupload’s data, but it will only be used as evidence. In addition, Megaupload said that it should regain access to the servers in order to use the data as evidence. Well, it seems like everyone wants to use that data as evidence in the trial.
