A new day has passed, a new hearing in the Megaupload trial has occurred with the same results for the website’s owner who was denied bail once again. Kim Dotcom’s lawyers urged the Judge to allow the Megaupload owner to go home because he has a serious medical condition that requires adequate treatment, while his home is pregnant with two twins.
The authorities said that Kim Dotcom represents a serious flight risk therefore he cannot be released because he will immediately flee the country. Dotcom’s problem is that he had the luxury to buy himself a helicopter, and the Judge believes that he may use it to get out of the New Zealand. However, Kim’s lawyer said that he is guaranteed not to leave the country because of several reasons including the fact that he wants to prove that he is innocent, and that the FBI is wrong.
Paul Davison QC, Dotcom’s lawyer, said that the 38-year-old man suffers from diabetes and that the treatment provided in prison is not adequate. Also he should be allowed to take care of his wife as she is currently pregnant, and nobody can take care of her. The lawyer added that he will fight extradition to the US at the High Court in New Zealand because the copyright infringement and money laundering accusations are unfounded.
On the other hand, Judge McNaughton at the Auckland District Court decided that the Megaupload owner will be held in custody until the extradition trial will take place on February 22nd. Although Kim Dotcom appealed the decision, Justice Raynor Asher denied Megaupload’s owner bail once again.
Kim Schmitz also owns a private small airplance which can be used by him to flee the country. Mr. Davison reiterated that Dotcom will not attempt such a dumb move because there is nowhere to run, and fleeing the country would mean that he’s admitting that he is guilty.
Dotcom’s lawyer also complained that his client is being mistreated in prison where he was taken in the so-called Red Room. Dotcom was found in a secure panic room, and he was punched in the face, then kicked to the floor. While on the floor, a policeman was on Dotcom’s hand so bad that he broke his nail, and his hand started bleeding. The Megaupload owner added that such aggression isn’t necessary.
So far, Kim Dotcom has cooperated with the authorities, and he even reported some of the “funny visits” he experienced. The German national explained that a lot of funny people have visited him in prison including several women who wanted to become his friend. In addition, he received a phone call from a person who guaranteed that he will help him get bail in exchange for a large amount of money.
It appears that Kim Schmitz refused the man’s offer, and he revealed the phone number to a police officer. Another funny call that Dotcom refused was from an “expert document forger.” The cause of the call is currently unknown, but it is believed that he wanted to help Megaupload’s owner by giving him a fake ID to live in another country.
Although Megaupload’s owner said that he has “no desire to run away,” the court denied his appeal and he will remain in prison until the extradition hearing on February 22nd.
